WHY According to the World Health Organization’s statistics, 36 million people have died of HIV/AIDS since the first reported incidences in 1981. Globally, 42 million people are currently living with the disease. Since 2012, 1.2 million people have died, and 2.3 million new cases have been reported across the globe. There are approximately 1.2 million people living with HIV/AIDS in the United States. Of those, approximately 240,000 are unaware of their HIV-positive status. To date, nearly 300,000 women are included in the horrific number of those afflicted. In spite of the headway being made, infection rates are increasing rapidly. African Americans, Gay and Bi-Sexual Men of all ethnicities and Latinos are the hardest-hit demographics.

WHO The WORLD AIDS AWARENESS WEEKEND (WAAW) is a collaborative effort comprised of global and civic leaders, front-line agencies and individuals who advocate for a HIV/AIDS-free world. Through our marketing efforts, over 500,000,000 people will be reached through Radio, TV and the World-Wide Web. We anticipate10, 000 attendees will participate in the activities, including 4,000 plus people who will get tested for the first time.

Monterey, CA, June 27, 2014 - Under what circumstances may a former employee solicit his former employer’s customers? And can non-solicitation agreements ever be enforceable?


Those questions came closer to being answered in California — a state that rarely permits any action which is seen to inhibit or reduce competition — when a Santa Cruz superior court granted a temporary restraining order against a former employee of Echo Holdings LLC.

Represented by Monterey law firm Hudson Martin Ferrante Street Witten & June, PC, Echo was granted the rare TRO on June 18, 2014, against a former employee who has been accused of stealing valuable trade secrets and pursuing the company's existing customers. Firm partner Amy June argued the case in one of the few states in which non-compete agreements are considered void as against public policy.

The state’s Business and Professions Code section 16600 provides that “Except as provided in this chapter, every contract by which anyone is restrained from engaging in a lawful profession, trade, or business of any kind is to that extent void.” Exceptions to this rule are limited, and focus on the sale of a business or dissolution of a partnership. However, through adoption the Uniform Trade Secrets Act, California also makes it illegal for employees to misappropriate trade secrets from a former employer and to use those trade secrets to solicit customers of the former employer.

Hudson Martin Ferrante Street Witten & June, PC, has long represented One Stop Logistics, Inc., which acquired Echo in May of 2014. June, who argued the matter before Presiding Judge Paul Marigonda, agreed that the ruling was appropriate and necessary to protect the company's interests in the area.

The decision comes on the heels of May’s ruling by Judge James Robertson of the San Francisco Superior Court in the case of Guardsmark v. Bowman.

In that case, Guardsmark, a company that provides security services, won a rare non-compete order against a former manager who had signed an agreement stating that he would refrain from misusing Guardsmark’s confidential information, but who secretly formed a competing security services company, Teton Security Services, Inc., and won a contract to work with a former Guardsmark client.

Judge Robertson ordered a permanent injunction prohibiting Bowman and Teton from contacting or soliciting any of Guardsmark’s current customers in San Francisco and from taking any action to induce any of Guardsmark’s current customers in San Francisco to discontinue service with Guardsmark.

Mountainsong represents some of the greatest artists of our time from coast-to-coast.


Mountainsong Galleries recently hosted a solo exhibition for Master Artist Albert Handell. Handell is a credentialed Master Artist in both the Oil Painters of America and the American Impressionist Society. Handell is the poster child for overcoming adversity. As a child he was sickly and his Mother would not permit him to go outside to play. He was restricted to the sidewalk outside his home with a box of chalk. From this childhood he emerged as one of the greatest pastelists of our time, having been nominated to the Pastel Hall of Fame over three decades ago.

Most recently, Handell was awarded the Bronze Medal in the Masters Category at the 2013 OPA National Exhibition for his oil painting, L’Abre, which currently hangs at Mountainsong Galleries. His works have hung in museums from coast-to-coast including the prestigious Butler Institute of American Art.

Handell hosted a workshop this past May with several local Monterey County residents who are inspiring artists. On Saturday, July 5th at 5:30 p.m.

workshop participants will have their paintings on display at the prestigious Mountainsong Galleries which only hangs works by OPA and AIS Masters.

Background on Alan Wolton
Renowned artist and Sedona resident, Alan Wolton has just returned from Bennington, Vermont, where he was the recipient of the Distinguished Artist of the Year from Oil Painters of America – "OPA."

Already an "OPAM" – recognized as "master painter" by the group, Wolton has had an illustrious career spanning six decades. 

Wolton’s work has been accepted by the Royal Academy of London, the Royal Society of British Artists, the Royal Institute of Oil Painters, and the Paris Salon. He has also been a  Master Charter Member of the Society of American Impressionists and a member of Plein Air Painters of Northern California.

His work has been exhibited all over the world, including London, Johannesburg and Paris. His peripatetic nature has led to the creation of powerful art from many beautiful places, including his original South African home, New Zealand and Europe – notably Venice.

An excerpt from the OPA's announcement about the award states, "Alan Wolton is indulging in an artistic freedom brought about by his years of development and the confidence of maturity. By 1978, Jim and his wife had moved to Seattle, where Jim’s work gradually shifted away from commercial illustration to primarily historical aviation, automotive and military art. Today his work is internationally known and collected, and his style, with its emphasis on depth of story, is recognized by collectors of historical art. In 2001, Barnes & Noble Publishing released a book on Jim’s World War II art, entitled Portraits of Combat. In 2005, Jim fulfilled a childhood dream when he got the opportunity for a cameo role in Peter Jackson’s (Lord of the Rings) remake of King Kong. Jim plays the role of pilot of the Curtis Helldiver aircraft which fires at Kong while he is perched high above New York on the Empire State Building.

Jim and his wife, Patti, live in Seattle with their dog, Sarah, who shares the distinction with previous Dietz pets, of being a regular in Jim’s paintings. Their son, Ian, is currently an officer serving in the U.S. Army. Jim works in a warm, pleasantly cluttered studio that resembles a WWI aviation bar, surrounded by uniforms, props and models that have made their way into paintings over the years.

Artist Fawn Rogers “I Love You And That Makes Me God”

Amid the bustle of the Paris Photo VIP Opening at Paramount Studios, I sat down with artist Fawn Rogers for a chat about her new installation, works currently on view, and the crossover of public and private dialogue in art.

Los Angeles, CA, June 11, 2014 - TG: I recently had the chance to check out your installation of ten new works at The Bank showroom in downtown L.A. Can you tell us a bit about that installation?

FR: The Bank is a powerhouse space, and Jeannine Braden is great to work with. I’m excited to be showing work there, both from the Visible Light series and a couple of new paintings.


TG: In the area known as “The Vault” you have two large canvasses on either side of the entrance to a walk-in vintage bank vault. Can you tell us a bit about those works?

FR: Those two works are the first canvasses I’m showing publicly from my new project, “I Love You And That Makes Me God.” One of the elements of the new work is interaction with settings of potential worship, including financial.

TG: What other locations are you using for this work?

FR: Anyplace that houses an object of worship is fair game. Strip clubs, churches, vice-driven advertisements, etc.

TG: How does the public art interact with the video installation you’re creating?

FR: In some ways it’s a reaction. The level of intimacy of the video project is so intense, so personal, that it demanded an opposite response. This project encounters dialogue at the direct one-on-one level, and as an indeterminate public conversation.

TG: Some of those settings – strip clubs, cathedrals – might be seen as a bit controversial, right?

FR: Sure. But again, the goal of the project is to invite dialogue, not to impose meaning. Unless I get the chance to project it onto the walls of the Vatican. [Laughs]

TG: With a central statement as provocative as “I Love You And That Makes Me God,” faith, or belief, has to be part of the conversation in some way.

FR: It’s been a ride to explore.

TG: What is your experience of the faith aspect of the work, personally?

FR: The Bible, Torah, Quran – books of science? They’re texts of pervasive cultural impact. The project is not about religion, at least not in any conventional sense.

TG: What shape is the video installation aspect going to take?

FR: I’m working right now on developing a few different models. One is a small-scale installation box, designed with interior monitors and mirrored glass. The viewer approaches by putting their head inside the box to view the work. It’s very intimate, and meant to be a bit uncomfortable. The second model is a large-scale design, with dual-monitor projection spanning a space of about 800 cubic ft. It’s technically involved.

TG: You’ve mentioned a lot of social themes in conjunction with the project. If you had to summarize the work, what is “I Love You And That Makes Me God” about?

FR: I look forward to you experiencing the installation and letting me know.

Daniel E. Greene, N.A. is a former instructor of painting at the National Academy of Design and the Art Students League of New York. He is the author of "Pastel" that was in print for 25 years and "The Art of Pastel," which were published in English, French, German, Spanish, Italian and Chinese. In 1969, Mr. Greene was elected to the National Academy of Design.

The Encyclopedia Britannica considers Mr. Greene the foremost pastelist in the United States and in 1983, the Pastel Society of America elected him to the Pastel Hall of Fame. In 2003, the Pastel Society of the West Coast named Mr. Greene a Pastel Laureate. In 1989, his work represented the United States at the first International Biennial of Pastel in San Quentin, France. In 1992, he was awarded American Artist's magazine's first Lifetime Achievement award in the category of oil painting and the Oil Painters of America Society named him to their Hall of Fame. In 1995, the American Society of Portrait Artists presented the John Singer Sargent award to Daniel Greene for lifelong dedication to the achievement of excellence in portraiture. In May 1999, Mr. Greene was the recipient of the Benjamin Clinedinst Medal of the Artist's Fellowship at a presentation in New York City. In 2001, he was awarded the Gold Medal of the Portrait Society of America. On May 26, 1994 in a special White House ceremony, Mr. Greene presented to Hillary Rodham Clinton a pastel portrait of Eleanor Roosevelt. In 2003, Mr. Greene was the annual honoree of the Salmagundi Club and was presented their Gold Medal. In 2003, Mr. Greene was named a Pastel Laureate by the Pastel Society of the West Coast and was presented with the Joseph V. Giffuni Award by the Pastel Society of America.

In 2006, Mr. Greene was the Artist in Tribute at the 75th Annual Exhibition of the Hudson Valley Art Association. In 2007, Mr. Greene was presented with the Gladys E. Cook Award for Painting by the National Academy Museum at their 182nd Annual Members Exhibition. In 2007, Mr. Greene was presented with the Great American Artworks Award by the Pastel Society of America and also won First Place for Landscape at the ARC International Salon by the Art Renewal Center. In 2011, Mr. Greene was presented with the Herman Margulies Award for Excellence by the Pastel Society at their 39th Annual Exhibition and also was presented with the Art Spirit Foundation Award by the Salmagundi Club at their 128th Annual Member Exhibition. In 2012, the Connecticut Society of Portrait Artists at the conference "Faces of Winter - A Daniel Greene Festival" honored Mr. Greene with their Lifetime Achievement Award. In 2012, Mr. Greene was presented with a Distinguished Artist Award by the Oil Painters of America at their 21st Annual National Juried Exhibition of Traditional Oils and was presented with the Gene Magazzini Memorial Award for Traditional Oils by the Salmagundi Club at their 129th Annual Exhibition.In 2012, the Pastel Society of America at their 40th Annual Exhibition also presented Mr. Greene with the Jack Richeson Gold Award.

Mr. Greene's paintings and pastels are in over 700 public and private collections in the United States and abroad. He has been the recipient of the Elizabeth T. Greenshields Foundation grant and the Anna Lee Stacey Foundation grant. A retrospective exhibition of Mr. Greene's paintings and pastels was held in 1987 at the Hammond Museum in New York. Five highly successful exhibitions of Mr. Greene's subway series appeared in New York and were featured on ABC-TV, Fox News, PBS, CNN, New York 1, NHK TV Japan, and in over 50 international magazines and newspapers. One exhibition "Subway Paintings" at the New York Transit Museum at Grand Central Terminal was the inaugural event in the centennial year of the New York subway. Mr. Greene has been the featured artist in American Artist magazine 15 times. Articles about his work have appeared eight times in the Artist's Magazine. Favorable reviews have appeared three times in Art News magazine. In February 1999, Mr. Greene's paintings were featured in a cover article of the International Artist magazine. In 1998 Daniel Greene was interviewed in the Academy Award nominated documentary "Ayn Rand, a Sense of Life" and was the subject of the cable documentary "The Genuine Article" as well as a PBS documentary featuring his subway paintings. Mr. Greene's figure and still-life paintings are handled by Mountainsong Galleries in Carmel-by-the-Sea, California, Eleanor Ettinger Gallery in New York, New York, Cavalier Gallery in Greenwich, Connecticut as well as Nantucket, Massachusetts and Miller Gallery in Cincinnati, Ohio. Highly regarded as a portrait artist, his subjects include leaders of government, banking, education, and industry. A few of the early works include Mrs. Eleanor Roosevelt, astronaut Walter Schirra, author Ayn Rand, and William Randolph Hearst. Some governmental portraits include Governor Scott of North Carolina, Governor Laxalt of Nevada, Governor Beliles of Virginia, Governor Lehman of New York, as well as two mayors of New York City. Some later portraits include Dave Thomas of Wendy's, Governor Fob James of Alabama, commentator Rush Limbaugh, Congressman Billy Tauzin, composer Alan Menken and Bryant Gumbel of CBS. Some recent portraits include John and Adele Lehman for Harvard, Eric Widing of Christie's and Governor Benjamin Cayetano of Hawaii. A partial list of sitters includes the chairmen of the boards of Honeywell, Coca-Cola Company, Dupont Corporation, American Express, the New York stock exchange and IBM. Mr. Greene has also painted the deans and presidents of: Tufts, Duke, Columbia, North Carolina, West Point, Delaware, New York, Princeton, Rutgers, Yale and Harvard universities.
